Order and price modalities
- Customers must be over 16 years old and have the possibility to place all their orders from the website: https://www.movilplanet.eu
- Each customer declares with full capacity to use bank cards and that they have sufficient funds to cover all the costs that result from the purchase of products in Movil Planet, in case this was the means of payment used by it.
- When creating your user account, the customer declares to accept fully and without reservation all of these General Sales Conditions.
- The data recorded by Movil Planet constitute proof of the transactions made between Movil Planet and the members of its Private Community.
- Movil Planet will confirm your order when it is in preparation by sending an email.
- The contractual information is presented in Spanish and will be confirmed at the latest at the time of delivery.
- The prices of our products include taxes and corresponding shipping costs.
- It is possible to confirm the tax of a product by adding it to the Cart.
- Movil Planet does not set any minimum purchase amount.
- Movil Planet reserves the right to change its prices at any time, but the products will be billed on the basis of the rates in force at the time of order registration (subject to availability of the product), unless typographical error manifest.
- The products remain the property of Movil Planet until the moment in which the shipment has been confirmed.
- Movil Planet reserves the right to refuse an order from any member with whom it has a dispute or when considering clear indications of fraudulent use of its services.
Availability
Movil Planet will do everything possible to please all its customers in the demand for the products.
In the event that Movil Planet cannot meet the delivery deadline due to lack of stock, customer service will contact the buyer within 1 to 3 business days to notify him and proceed to confirm the approximate date of delivery, change or cancellation of the order. Following this demand, the speed of the refund in the buyer's bank account will depend on the type of bank card and method of payment used, as well as the conditions established between the client and his own bank.
Orders pending receipt of payment or confirmation of approval by financial institution will not reserve material.
Orders will be confirmed at the time the status was "Payment accepted".
Movil Planet will do everything possible to keep the availability up-to-date according to the stock of its own warehouse and third-party according to the information provided by the companies supplying the products.
Movil Planet will not be responsible for out of stock or unavailability of the product derived from the wrong information provided by the supplier companies or third-party warehouses.
Security
For your security, Movil Planet has relied on the payment system by credit card to a payment gateway.
The bank details entered are encrypted and transmitted securely to the servers of this payment platform and, subsequently, are verified with the issuing bank and PayPal to avoid possible fraud and abuse. This data entry procedure is guaranteed by SSL (Secure Socker Layer) -128 bits encryption technology, one of the most advanced and effective protection systems currently available, thanks to which no third party will have access to this relative information via Internet to the bank details entered by the customer.
Only you have access to the banking data linked or used as means of payment in PayPal, so that Movil Planet does not know or register this data during the payment process.
Desistence
You have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days from the day on which you, or a third party other than the carrier and indicated by you, acquired physical possession of the last of the goods.
To exercise your right of withdrawal, you must notify us (Movil Planet, Calle Reserva, 46 - Office 15, 29130 Alhaurín de la Torre -Málaga-, Spain; contacto@movilplanet.eu; +34 951 59 26 99 / +34 651 050 019) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., by email or a letter sent by post). You may use the model withdrawal form that we will send you, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal:
- If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than our least expensive standard delivery option), without undue delay and in any event no later than 7 calendar days from the date we receive and inspect the returned goods.
We will carry out this reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest. - You must return or deliver the goods to us directly without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be considered met if you return the goods before the end of this period. The products must be returned properly protected, completely disconnected and untracked, factory reset and unlocked, in their original packaging with all accessories and documentation.
- You will be responsible for the direct cost of returning the goods, which is €19.90 + VAT, for example, for mobile phones, provided the merchandise is insured, should you prefer that we arrange for their collection.
- You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Specifically, a 15-25% discount will be applied to products that appear to have been tampered with or activated for an extended period; for products showing evidence of prolonged use (repeated battery charging cycles, visible signs of wear, etc.), a 30-50% discount will be applied.
- If a return cannot be accepted because the product does not meet the legal requirements, it will be held in the distribution warehouse for the customer to collect from our office for a period not exceeding 30 calendar days from the date of the return. After this period, the products will become the property of Movil Planet, and the customer will no longer have the right to collect or claim them.
The right of withdrawal does not apply to contracts relating to:
- The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the business cannot control and that may occur during the withdrawal period.
- The supply of goods made to the consumer's specifications or clearly personalized.
- The supply of goods liable to deteriorate or expire rapidly.
- The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
- The supply of goods which, after delivery, have been inseparably mixed with other goods.
- The supply of alcoholic beverages whose price has been agreed upon at the time of the conclusion of the sales contract and which cannot be delivered before 30 days, and whose actual value depends on market fluctuations beyond the trader's control.
- The supply of sealed audio or video recordings or sealed computer software which have been unsealed by the consumer after delivery.
- The supply of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
Warranty
Guarantees and after-sales services will be governed by Royal Legislative Decree 1/2007 of November 16 that approves the text of the General Law for the Defense of Consumers and Users. In accordance with this rule, the seller is obliged to deliver to the consumer and user products that are in conformity with the contract, responding to him of any lack of conformity.
The consumer and user have the right to repair the product, its replacement, the price reduction or the termination of the contract.
From January 1st, 2022 all products are new. all our products have a 3 year warranty according to the terms and conditions of each manufacturer.
For products processed under warranty whose breakdown or defect is not covered by it when these conditions are not met, the client will be charged a handling fee of € 35 + VAT 21% corresponding to the costs of collection, verification and return the product.
Liability, litigation and applicable legislation
Movil Planet could not be held liable for breach of the contract concluded in the event of a stock break or unavailability of the product, force majeure, disruption or total or partial strike, in particular, of postal services and means of transport and / or communications, flooding or fire.
In case of litigation, the client will go by priority to Movil Planet to obtain a friendly solution.
The Courts of Malaga are the only competent. These general conditions of sale will be interpreted in Spanish and will be carried out in accordance with Spanish law. Any disagreement that could arise due to its validity, its interpretation or its execution will be presented to the Courts of Malaga, to which the exclusive attribution of competence is expressly made.
Modification of the general conditions of sale
Movil Planet reserves the right to modify these conditions with prior notice, being able to change, delete or add both the contents and services provided through it and the way in which they are presented or located on their servers. These changes must be communicated to the User and if not indicated otherwise, they will be considered compliant after checking the continuity of the use of Movil Planet content and services.
The members of the "Movil Planet Private Community" who are not satisfied with the modifications of the general conditions, must communicate it and, from the date on which these new conditions will take effect, they must stop using the Movil services Planet.
In the event that any of the terms of the general conditions were illegal or unenforceable, it will be void in full and applying what was agreed by the parties and failing that stated in the Spanish Civil Code.
