2. PURPOSE AND SCOPE

These General Terms of Use govern access to, browsing and use of www.movilplanet.eu (the “Website”), operated by Movil Planet.

The Website provides information about technology products and services offered by us or partner businesses and facilitates their online sale and purchase.

Accessing and browsing the Website makes you a user and requires compliance with these terms where applicable. Mere browsing, however, does not amount to acceptance of contractual purchase obligations or replace any consent that must be expressly given.

Purchases are also subject to the General Terms and Conditions of Sale available on the Website.

Movil Planet may change the Website's presentation, structure, content and functions and update these terms for legal, technical, commercial or organisational reasons.

Changes apply from publication unless otherwise stated and do not retrospectively affect existing contracts or acquired user rights.

3. ACCESS, REGISTRATION AND SECURITY

General information is normally accessible without registration. Certain functions, including order management, purchase history and personal information, may require a customer account.

Users registering must provide true, complete and current information and use appropriate login credentials.

4. PROPER USE OF THE WEBSITE AND SERVICES

Users agree to use the Website, its content and services lawfully, carefully and with respect for the rights of Movil Planet, third parties and other users. In particular, users must not:

• Use the Website for unlawful or fraudulent activities or to infringe third-party rights.
• Introduce, transmit or distribute viruses, malware, harmful code or anything intended to disrupt IT systems.
• Attempt unauthorised access to accounts, servers, databases, restricted areas or systems.
• Interfere with normal operations through attacks, abusive requests, resource overload or harmful methods.
• Impersonate others or use false information fraudulently.
• Send unsolicited marketing or collect other users' personal data without lawful grounds.
• Reproduce, distribute, modify or commercially exploit protected content without permission or a legal entitlement.
• Use bots, crawlers, automated extraction tools, scraping or equivalent methods to systematically copy, collect or exploit information, images, descriptions, prices, product listings or Website databases without authorisation, except where permitted by law.
• Carry out mass or repeated extraction that harms Website operations, infringes intellectual or industrial property rights or constitutes unauthorised exploitation of protected databases.
• Circumvent technical security measures, lawful access restrictions or mechanisms protecting content and services.

Movil Planet may use reasonable technical and organisational measures to prevent, detect and limit such behaviour.

Where there is objective evidence of a serious breach, Movil Planet may proportionately restrict access, suspend functions or block an account temporarily, without prejudice to continuing contractual and statutory obligations.

Users are liable for losses caused by unlawful acts or breaches legally attributable to them.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

Website content—including text, photographs, images, graphics, logos, designs, visual elements, product listings, descriptions, navigation structures, databases, source code and software—is protected by applicable intellectual and industrial property laws.

Rights belong to Movil Planet or their respective owners, manufacturers, distributors or other parties who have authorised use.

Access does not transfer or grant exploitation rights except where expressly authorised or legally permitted. Unauthorised reproduction, distribution, public communication, adaptation or commercial exploitation of protected content is prohibited.

In particular, systematic copying of product listings, commercial descriptions, original photographs, catalogue structures or protected data collections for publication or commercial use on other websites, marketplaces or digital services is not permitted without authorisation or a legal entitlement.

Where legal requirements are met, database protection extends to structure, selection, arrangement and content, including any rights of the database maker.

Third-party trade names, brands, logos and distinctive signs belong to their owners and appear for legitimate identification, information or product marketing.

Restrictions do not affect uses permitted by law, including intellectual property exceptions and limitations, or legitimate third-party rights.

Movil Planet reserves the right to take appropriate legal action against unauthorised use or infringement. Reports of possible intellectual or industrial property infringement may be sent to contacto@movilplanet.eu.

6. REVIEWS, RATINGS AND USER-SUBMITTED CONTENT

Where users may publish reviews, ratings, comments or other content, they must ensure it is lawful, factually accurate where facts are asserted, and respectful of third-party rights.

Threats, unlawfully discriminatory material, third-party personal data without lawful grounds, unauthorised advertising and infringing material are not permitted.

Users retain their legal rights in original content they publish. By submitting it for publication, they grant Movil Planet a non-exclusive, royalty-free authorisation to store, reproduce and publicly communicate it to the extent necessary to display, manage and maintain it on the Website and related functions.

This is not a general, unlimited assignment of exploitation rights. Any additional commercial use requiring permission will be handled under applicable law.

Movil Planet may remove or restrict access to unlawful content or content that demonstrably breaches these terms, subject to required procedures and safeguards. Where digital intermediary service rules apply, we will provide the appropriate notice and action mechanisms.

7. WEBSITE AVAILABILITY AND OPERATION

We endeavour to keep the Website accessible, current and operating properly. Temporary interruptions may arise from maintenance, updates, technical problems, connectivity or power failures, cyberattacks or other events.

We may temporarily suspend access or functions where necessary for security, maintenance, fraud prevention or protection of systems and users. We will try to minimise downtime and restore service promptly where reasonably possible.

We cannot guarantee uninterrupted availability or complete absence of technical errors or security vulnerabilities. Responsibility for incidents is determined under applicable law according to cause and each party's obligations.

These provisions do not exclude or restrict statutory consumer rights or Movil Planet's liability for breaches attributable to it.

8. ACCURACY AND UPDATING OF INFORMATION

We strive to publish clear, accurate and current information. Typographical errors, display differences, stock synchronisation issues or changes to manufacturer or supplier specifications may nevertheless occur.

Movil Planet may correct material errors and update specifications or information without prejudice to obligations under existing contracts. Product information must be read together with specific conditions communicated during checkout.

If incorrect information affects an order or essential characteristics of the contracted product, consumers retain all statutory information, conformity and other rights. General content does not replace official manufacturer technical instructions, safety warnings or documents where needed for proper product use.

9. LIABILITY AND FORCE MAJEURE

Movil Planet is liable for its obligations as provided by law.

It is not liable for losses caused exclusively by users' unlawful or negligent conduct, failures of third-party services beyond its control or force majeure, to the extent not legally attributable to Movil Planet. Force majeure may include unforeseeable or unavoidable events meeting statutory requirements.

A technical issue, cyberattack or supplier failure does not automatically release Movil Planet from liability: the specific circumstances and legal duties must be considered.

Users are responsible for harm caused by unlawful conduct or contractual breaches attributable to them. Movil Planet may claim actual damages and legally recoverable reasonable costs where there is a sufficient legal basis.

Nothing in these terms excludes non-waivable consumer rights or liability that cannot legally be limited.

10. LINKS TO THIRD-PARTY WEBSITES

The Website may link to manufacturers, suppliers, financial institutions, payment platforms, repair services or other third parties for information or related services.

A link does not necessarily mean Movil Planet controls, endorses or assumes responsibility for all linked content or services. We do not generally control changes made by third parties and are not liable for their content or actions unless legally required.

Please review external sites' terms and privacy policies before use. Where a third-party service forms part of a transaction contracted with Movil Planet, that party's involvement does not reduce Movil Planet's legal responsibilities to the customer.

11. PERSONAL DATA AND COOKIES

Personal data is processed in accordance with the GDPR, Spanish Organic Law 3/2018 and other applicable legislation.

Our Privacy Policy provides details of purposes, legal bases, recipients, retention periods and data subject rights. Cookies and similar technologies are governed by our Cookie Policy.

Where consent is required for particular cookies or processing, mere browsing or remaining on the Website will not constitute consent.

12. OFFICIAL COMPLAINT FORMS

Movil Planet makes the official complaint forms of the Regional Government of Andalusia available to consumers as required by law. Consumers may ask our customer service team how to submit a complaint.

Complaints may be submitted using legally authorised methods, including official electronic procedures where available and applicable.

Information about Andalusian consumer procedures is available through Consumo Responde: https://www.consumoresponde.es.

Movil Planet will respond to official complaint forms with a reasoned written response within a maximum of 10 working days of receipt, in accordance with Andalusian regulations. The response will state the proposed solution or reasons for rejecting the complaint and include legally required information on alternative dispute resolution mechanisms.

Consumers retain their right to approach consumer authorities and applicable dispute resolution bodies.

13. GOVERNING LAW AND JURISDICTION

These General Terms of Use are governed by Spanish law, without prejudice to applicable mandatory rules.

For consumers, disputes will be heard by courts with jurisdiction under applicable law, without imposing a territorial jurisdiction clause that restricts statutory rights.

For business-to-business relationships, the parties may expressly submit disputes to the courts of Málaga where such agreement is legally valid.

If any provision is found void, invalid or unenforceable, the remainder will continue to apply insofar as legally possible.
